Tax on Dubai Property for US, UK and European Owners: Home-Country Tax, CRS and FATCA

Dubai does not tax your rental income or your profit when you sell. Your home country usually does, and it will know about your UAE bank account. The zero in Dubai matters only once you stop being a tax resident somewhere else. This guide explains how the United States, the United Kingdom and European countries treat Dubai property, and how the CRS and FATCA reporting systems work.

Indian buyers have their own rules: see buying Dubai property from India.

The short version

If you are tax resident inRental income from DubaiGain on saleReported automatically?
United States (or a US citizen anywhere)Taxed in the USTaxed in the USYes, under FATCA
United KingdomTaxed in the UKTaxed in the UKYes, under CRS
An EU countryUsually taxed at homeUsually taxed at homeYes, under CRS
The UAE, having properly left your home countryNo taxNo taxReported to the UAE only

In each case there is no UAE tax to set against the home-country bill, so you pay the full home rate.

What the UAE charges

For an individual owner: no tax on rent, no capital gains tax, no annual property tax and no inheritance tax. You pay the 4% DLD fee when you buy and service charges each year. See the Dubai property tax guide. Owning through a company is different, because UAE corporate tax can apply.

United States

The US taxes citizens and green-card holders on worldwide income wherever they live, so moving to Dubai does not end US tax.

  • Rent is reported on Schedule E of Form 1040. You can deduct expenses such as service charges, management fees and repairs.
  • Depreciation on foreign residential rental property is taken over 30 years, against 27.5 years for US property.
  • Sale: the gain is reported on Form 8949 and Schedule D at US capital gains rates. Gains are calculated in US dollars. Because the dirham is pegged to the dollar, exchange rate movements rarely change the result.
  • State tax may also apply if you are resident in a state that taxes worldwide income.
  • No treaty relief. The US and the UAE have no comprehensive income tax treaty, and with no UAE tax paid there is no foreign tax credit.

Reporting. The property itself, if you own it directly in your own name, is not reported on the FBAR or Form 8938. Your UAE bank accounts are:

FormWhat triggers it
FBAR (FinCEN Form 114)Foreign accounts totalling more than USD 10,000 at any time in the year
Form 8938 (FATCA)Specified foreign financial assets above thresholds that start at USD 50,000 and are higher for taxpayers living abroad

If you hold the property through a foreign company, more reporting applies. US estate tax also covers worldwide assets for US citizens, including Dubai property.

United Kingdom

UK residents are taxed on worldwide income and gains.

  • Rent is declared on the foreign pages of the self-assessment return and taxed at your income tax rate, after allowable expenses.
  • Sale: capital gains tax applies to the gain, calculated in sterling. Because you bought and sold in dirhams, exchange rate movements can create a taxable gain even if the dirham price did not change.
  • The UK-UAE tax treaty does not remove the UK tax for UK residents.
  • Leaving the UK ends UK tax on the rent once you are non-resident under the statutory residence test, but anti-avoidance rules can tax gains if you return within a few years.

European Union countries

The pattern is the same: residents are taxed on worldwide income, and the UAE’s zero rate gives no credit to offset.

  • Tax treaties between the UAE and European countries vary. Most leave the home country free to tax its residents. A few work differently, and at least one major treaty has lapsed, so check the position for your own country.
  • Some countries add wealth tax or real-estate wealth tax that counts foreign property.
  • Stopping home-country tax requires really leaving: passing the day-count test and cutting the ties, such as a home, family and business, that your country uses to decide residence.

CRS and FATCA: what gets reported

Two systems send information about UAE accounts to tax authorities abroad.

What this means for a property owner:

  • The property is not reported directly, but the bank account that receives the rent or sale proceeds is.
  • Your UAE bank will ask for your tax residence and tax identification number when you open an account. Answer accurately.
  • The UAE takes part in both systems, so assume your home tax authority can see UAE account balances.
  • Reporting for crypto-assets is being added under a separate OECD framework from 2027.

Becoming a UAE tax resident

The zero rate becomes real when you are tax resident in the UAE and no longer tax resident at home. The UAE treats you as resident if you spend 183 days in the country in a year, or 90 days if you have a residence visa and a home or job there. You can then apply for a tax residency certificate.

Your home country applies its own tests, and they are usually harder to meet than the UAE’s. Both must be satisfied. See how to evaluate Dubai residency options and the Dubai tax illusion.

Frequently Asked Questions

Do foreigners pay tax on rental income from Dubai property?

Not to the UAE. Most owners pay tax on it in the country where they are tax resident.

Does the US tax Dubai property owned by an American?

Yes. US citizens and residents are taxed on worldwide income, including Dubai rent and gains, with no UAE tax to credit.

Do I report my Dubai apartment on the FBAR?

Not the apartment itself if you own it directly. You do report UAE bank accounts if your foreign accounts total more than USD 10,000.

Will my home country find out about my Dubai property?

It will learn about your UAE bank accounts through CRS or FATCA, including the rent paid into them. Declare the property and the income.

Is there a double tax treaty between the UAE and my country?

The UAE has treaties with many countries, including the UK and India, but not a comprehensive income tax treaty with the US. A treaty rarely removes tax for someone who is still resident in their home country.

How do I stop paying tax at home on my Dubai property?

Only by ceasing to be tax resident there under that country’s rules and becoming resident in the UAE. For US citizens, even that is not enough.
